1. INTRODUCTION AND LEGAL AGREEMENT
These Terms and Conditions (“Agreement”) constitute a legally binding agreement between Barking Bekah’s Boutique (“Company,” “we,” “us,” or “our”) and any individual or entity (“Client,” “Owner,” or “you”) accessing our website, booking appointments, or utilizing our grooming services.
By accessing, browsing, registering, scheduling an appointment, or otherwise using our website or services, you expressly acknowledge, represent, and agree that:

You have read, understood, and accepted this Agreement in its entirety;

You are at least 18 years of age and legally capable of entering into a binding contract;

You are the lawful owner of the pet or have full authority to act on behalf of the owner;

You consent to all policies, procedures, and liability limitations contained herein.
This Agreement governs all interactions between the Client and the Company, including online bookings, in-person services, and any future transactions, unless otherwise modified in writing.
1.1 Electronic Acceptance
Use of the Company’s website or booking system constitutes valid electronic acceptance of this Agreement, which shall have the same legal effect as a handwritten signature.
1.2 Modifications
The Company reserves the right to update or modify these Terms at any time. Continued use of services following any updates constitutes acceptance of the revised Agreement.
1.3 No Waiver
Failure by the Company to enforce any provision of this Agreement shall not constitute a waiver of its right to enforce such provision in the future.
1.4 Safety Priority

All services are subject to the Company’s overriding obligation to prioritize:

Professional grooming standards
Where a conflict arises between Client instructions and pet safety, the Company’s professional judgment shall prevail.

2. SCOPE OF SERVICES
Barking Bekah’s Boutique provides professional pet grooming services, including but not limited to:

2.1 Bath & Tidy Services
​
Includes bathing, nail trimming, ear cleaning, anal gland expression, and sanitary trimming (face, feet, and hygiene areas). These services are intended for general hygiene maintenance and comfort.
​
​
2.2 Full Groom Services
​
Includes all Bath & Tidy services, plus full haircut and styling. Grooming styles may be tailored to breed standards or Client preferences; however, final results may vary depending on coat condition and pet behavior.

​
2.3 Service Limitations
​
All services are performed based on the following factors:

Size, breed, and physical characteristics of the dog
-
Coat condition, including matting, tangles, or shedding
-
Temperament, behavior, and tolerance for grooming
-
Overall health and any disclosed or observable conditions
​
The Company reserves the right to:

Adjust grooming methods or techniques
-
Modify requested styles
-
Extend service time or apply additional fees
-
Decline specific services where safety concerns arise
​

2.4 Discretion of Groomer
​
The Client acknowledges that grooming professionals may exercise reasonable discretion to ensure humane treatment and safe handling of the pet at all times.

3. ONLINE BOOKING AND APPOINTMENT TERMS
​
3.1 Booking System
​
Appointments may be scheduled through the Company’s website, by phone, or in person. Submission of a booking request does not guarantee acceptance, and all appointments remain subject to confirmation by the Company.

3.2 Accuracy of Information
​
Clients are required to provide complete and accurate information, including but not limited to:

Pet’s breed, size, age, and gender

Medical conditions or sensitivities
-
Behavioral history (including aggression, anxiety, or biting incidents)

Failure to disclose material information may:

Result in refusal or termination of services
-
Lead to additional charges
-
Limit or eliminate the Company’s liability

3.3 Right to Refuse or Terminate Services
​
The Company reserves the absolute right to refuse, cancel, or discontinue services at any time where:

Safety risks to staff or the pet are identified
-
The pet exhibits aggressive or unmanageable behavior

Information provided is false, misleading, or incomplete
-
The pet’s condition makes grooming unsafe or inappropriate

3.4 Late Arrival Policy
​
Clients arriving late may have services shortened, rescheduled, or canceled at the Company’s discretion. Applicable fees may still apply.

4. PRICING, ESTIMATES, AND PAYMENT TERMS
​
4.1 Variable Pricing Structure
​
All prices listed or quoted are base estimates only and are subject to change based on:

Coat condition (including matting or excessive shedding)

Dog size, breed, and grooming complexity
-
Behavioral challenges or handling requirements
-
Time and labor required to safely complete services
4.2 Additional Charges
​
Additional fees may apply, including but not limited to:

Severe matting or de-matting procedures
-
Aggressive or difficult handling
-
Extended grooming sessions
-
Specialized treatments or products
The Client agrees to pay all additional charges reasonably incurred during the grooming process.

4.3 Payment Terms
​

Payment is due immediately upon completion of services, unless otherwise agreed in writing.

The Company reserves the right to require:

Advance deposits
-
Full prepayment
-
Valid payment method on file
-
4.4 Refusal or Failure to Pay
​
Failure to make payment may result in:

Refusal of future services
-
Requirement of prepayment for future bookings
-
Collection or legal recovery actions where applicable
5. CANCELLATION, RESCHEDULING, AND NO-SHOW POLICY
-
Cancellations made less than 24 hours prior to the scheduled appointment will incur a 50% service fee, which must be paid before rebooking.
-
Repeat late cancellations may result in a requirement for full prepayment prior to accepting future appointments.
-
Failure to attend a scheduled appointment without notice (“no-show”) will be treated as a late cancellation and subject to the same fees.
5.1 Enforcement

Outstanding cancellation or no-show fees must be settled prior to:

Scheduling any future appointments

Receiving additional services
5.2 Right to Refuse Service
​
The Company reserves the right to refuse future bookings from Clients who demonstrate a pattern of:

Late cancellations

Missed appointments

Non-compliance with scheduling policies
6. LATE PICK-UP AND BOARDING LIABILITY
Clients are required to retrieve their pet within 30 minutes of being notified that grooming services have been completed.

A late fee of $5 per every 5 minutes shall apply after the 30-minute grace period.
-
Late fees will continue to accrue until the pet is collected.
6.1 Non-Boarding Disclaimer

The Company operates solely as a grooming service provider and does not offer boarding or daycare services. Any pet remaining on the premises beyond the grooming period is not considered boarded and remains under limited supervision.

6.2 Owner Responsibility
​
The Client assumes full responsibility for timely pick-up. The Company shall not be liable for:

Stress, illness, or behavioral issues arising from extended stays
-
Any incidents occurring after the completion of grooming services
6.3 Failure to Retrieve Pet
​
If a pet is not picked up within a reasonable extended period and the Client cannot be reached:

Emergency contacts may be notified
-
Additional holding or handling fees may apply
-
The Company reserves the right to take appropriate action, including contacting local animal authorities if necessary
7. FLEA AND TICK CONTROL POLICY
If fleas and/or ticks are identified during grooming:

The Company will administer immediate treatment to prevent infestation and protect other animals and the facility.
-
A mandatory $15 fee will be charged to cover:
-
Treatment (including Capstar or equivalent products)
-
Additional time, labor, and sanitation procedures
-
7.1 Mandatory Compliance

This policy is strictly enforced and non-negotiable. Clients may not refuse treatment once infestation is identified.
​
​
7.2 Contamination and Risk
​
The Client acknowledges that untreated parasites pose a risk to:

Other animals
-
Staff
-
The grooming environment
The Company reserves the right to take any necessary measures to mitigate such risks.
8. PET HEALTH, SAFETY, AND OWNER WARRANTIES
The Client represents, warrants, and agrees that:

The pet is in sufficient health to safely undergo grooming procedures;
-
All known medical conditions, allergies, injuries, or sensitivities have been fully disclosed;
-
The pet is not suffering from any contagious or communicable condition unless expressly disclosed prior to service;
-
All behavioral concerns, including aggression, anxiety, or prior grooming incidents, have been disclosed.
8.1 Duty of Disclosure

Failure to disclose material information shall constitute a material breach of this Agreement and may:

Result in immediate termination of services
-
Lead to additional fees
-
Limit or eliminate the Company’s liability
8.2 Limitation of Liability
​
The Company shall not be liable for any injury, illness, or complication arising from:

Undisclosed conditions
-
Pre-existing medical issues
-
Age-related or underlying health factors
9. MATTED COAT RELEASE AND CONSENT
The Client acknowledges that severely matted coats present significant health and safety concerns and may require shaving or extensive de-matting.

Such procedures may result in:

Skin irritation
-
Minor cuts, abrasions, or nicks
-
Post-grooming sensitivity or behavioral changes
-
9.1 Authorization

By booking services, the Client expressly authorizes the Company to:

Remove matting by any humane means deemed necessary
-
Prioritize the pet’s comfort and welfare over cosmetic preferences
9.2 No Liability for Aftereffects
​
The Company shall not be liable for any aftereffects resulting from the removal of matting, including:

Skin conditions revealed after shaving
-
Irritation caused by previously hidden issues
-
Temporary or permanent coat changes
9.3 Additional Charges
​
Additional fees will apply based on:

Severity of matting
-
Time and labor required
-
Level of difficulty and risk involved
10. AGGRESSIVE OR HIGH-RISK PETS
The Client acknowledges that grooming may pose risks when pets exhibit aggressive or unpredictable behavior.
10.1 Right to Refuse or Terminate

The Company reserves the right, at its sole discretion, to:

Use humane safety restraints where necessary

Stop or modify grooming services at any time
-
Refuse future services for safety reasons
10.2 Immediate Termination
​
Services may be discontinued without notice if:

The pet poses a threat to staff or itself

Safe handling is not possible
10.3 Financial Responsibility
​
If grooming is discontinued due to behavior:

The Client remains responsible for payment of all services rendered up to that point

Additional handling fees may apply
10.4 Liability for Damages
​
The Client shall be fully responsible for any:

Injury caused to staff
-
Damage to equipment or property
-
Harm to other animals resulting from their pet’s behavior
11. INJURY, RISK ASSUMPTION, AND LIABILITY WAIVER
The Client acknowledges and agrees that:

Grooming services involve inherent and unavoidable risks, including but not limited to:
-
Cuts, nicks, or abrasions
-
Stress-related reactions
-
Sensitivity to grooming tools or products
-

Certain tools and equipment (including clippers, scissors, dryers, and restraints) may pose minimal but unavoidable risks during standard grooming procedures.
11.1 Assumption of Risk

The Client voluntarily assumes all risks associated with grooming services, whether known or unknown.
11.2 Release of Liability
​
To the fullest extent permitted by law, the Client hereby:

Releases and discharges Barking Bekah’s Boutique, its owners, employees, and agents from any and all liability, claims, damages, or expenses arising from grooming services;
-
Agrees not to pursue any claim except in cases of proven gross negligence or willful misconduct.
11.3 Limitation of Liability
​
In any event, the Company’s total liability, if established, shall be strictly limited to the amount paid for the grooming services provided.
12. EMERGENCY CARE AUTHORIZATION
In the event of a medical emergency involving the pet while in the care, custody, or control of the Company:

The Company is hereby expressly authorized to seek immediate veterinary treatment without prior notice to the Client where, in the Company’s reasonable judgment, such action is necessary to preserve the pet’s health or prevent further injury.

The Company will make reasonable efforts to contact the Client prior to obtaining treatment; however, failure to reach the Client shall not delay necessary care.
12.1 Financial Responsibility

The Client agrees to:

Bear full and sole financial responsibility for all veterinary services rendered, including but not limited to:

Examination fees
-
Treatment costs
-
Medications
-
Emergency or after-hours care
-
12.2 Limitation of Liability
​
The Company shall not be liable for:

The outcome of veterinary treatment
-
Any complications arising from such treatment
-
Decisions made in good faith to protect the pet’s welfare
13. ABANDONMENT AND FAILURE TO RETRIEVE PET
​
If a pet is not collected within a reasonable timeframe following completion of services, and the Client cannot be contacted despite reasonable efforts:

The Company reserves the right to take appropriate action, including:

Contacting emergency contacts provided by the Client
-
Engaging local animal control or relevant authorities
-
Transferring custody of the pet as permitted by applicable law

13.1 Accrued Costs
​
The Client shall remain fully responsible for all costs incurred, including:

Additional care or handling fees
-
Administrative expenses
-
Any third-party costs associated with the pet’s care or transfer
13.2 No Liability for Transfer
​
The Company shall not be liable for any consequences arising from the lawful transfer or handling of an unclaimed pet.
14. NO GUARANTEE OF GROOMING OUTCOME
The Client acknowledges that grooming results are inherently subjective and may vary depending on:

Coat condition, including matting or damage
-
Pet behavior and tolerance during grooming
-
Health conditions or sensitivities
-
Environmental or procedural factors
The Company does not guarantee:

Specific aesthetic results
-
Breed-standard perfection
-
Exact replication of requested styles
14.1 Acknowledgment of Variability

The Client agrees that all grooming outcomes are performed on a best-effort basis and that dissatisfaction with aesthetic results shall not constitute grounds for refund, dispute, or liability.
15. WEBSITE TERMS OF USE
By accessing or using the Company’s website or booking platform, the user agrees to:

Use the website solely for lawful purposes

Provide accurate and truthful information

Refrain from engaging in any activity that may disrupt or interfere with the website’s functionality
15.1 Prohibited Conduct

Users are strictly prohibited from:

15.2 Enforcement

16. INTELLECTUAL PROPERTY RIGHTS

All content associated with Barking Bekah’s Boutique, including but not limited to:

Marketing materials and service descriptions
are the exclusive property of the Company.
16.1 Restrictions

No content may be:

Copied, reproduced, or distributed

Modified or used for commercial purposes

Displayed publicly without prior written consent
Unauthorized use may result in legal action.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law:

The Company’s total liability for any claim arising out of or related to services shall be strictly limited to the amount paid by the Client for the specific service in question.

The Company shall not be liable for:

Indirect, incidental, or consequential damages

Loss of use, loss of enjoyment, or emotional distress

Veterinary expenses except where caused by proven gross negligence

17.1 Exclusive Remedy

The Client’s sole and exclusive remedy shall be limited to recovery of fees paid for services rendered.
18. INDEMNIFICATION
The Client agrees to indemnify, defend, and hold harmless Barking Bekah’s Boutique, its owners, employees, contractors, and agents from and against any and all:

Claims

Damages
-
Liabilities
-
Losses
-
Legal fees and expenses
arising out of or related to:

The behavior or condition of the pet
-
The Client’s breach of this Agreement
-
Any third-party claims involving the pet
19. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates.
19.1 Good Faith Negotiation

The parties agree to first attempt to resolve any dispute through good faith negotiation.
19.2 Jurisdiction and Venue
​
If a dispute cannot be resolved informally:

It shall be submitted to the courts of the applicable jurisdiction

The Client consents to the exclusive jurisdiction and venue of such courts
20. SEVERABILITY
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable:

Such provision shall be modified to the extent necessary to make it enforceable

The remaining provisions shall remain in full force and effect
21. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties and supersedes all prior:

No modification shall be valid unless made in writing and approved by the Company.
22. MODIFICATIONS AND UPDATES
The Company reserves the right to amend, revise, or update these Terms at any time.

The Client is responsible for reviewing these Terms periodically.
